There's a case that nobody wants to cite - it is as bad a case as ever passed before SCOTUS, almost as bad as Dred Scot.

It is Korematsu v. U.S. - 323 US 214 (1944)

It is disdained but not, as far as I can tell, directly overturned. Thus it arguably remains valid law in the US.

Korematsu was locked away by the US Gov't in one of the internment camps. The case pretty much said "well, it is war and extreme measures are understandable and OK".

Well, today it is clear that we are at war with Russia. It is as much a war as the Cold War with the Soviet Union. Perhaps it is warmer as evidenced by the increasingly well established fact of Russian interference in the 2016 election and subsequently.

So - and I am merely discussing - Biden could recognize this defacto state of war and establish internment camps for those who are helping Russia - TFG, Manafort, Bannon, etc etc.

It would cause a political firestorm, so this is merely a hypothetical intellectual comment.
